Terms of Service

These Terms of Service (“Terms”) govern your use of the Card Zephyr mobile application (the “App”), provided by Card Zephyr (“we,” “us,” or “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your personal, non-commercial use, subject to these Terms and the rules of the app store from which you obtained it.

2. The Service

Card Zephyr is a tool that helps you store and organize gift cards and loyalty cards on your device, scan and display barcodes, and record balances. The App is a convenience tool for organizing your own cards. It does not issue, sell, redeem, or add value to any card, and it is not affiliated with, endorsed by, or sponsored by any merchant, brand, or card issuer.

3. Your Responsibilities

You are responsible for:

• The accuracy of the information you enter, including balances, which you record and maintain yourself.
• Keeping your device and the App secure, including using a device passcode and the App’s biometric lock.
• Backing up your data. Because your data is stored on your device, uninstalling the App, losing your device, or device failure may permanently delete your data.
• Complying with the terms of the merchants and card issuers whose cards you store.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose, including storing cards you are not authorized to use.
• Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by law.
• Interfere with or disrupt the App, or attempt to gain unauthorized access to it or its related systems.
• Use the App to infringe the rights of others.

5. Intellectual Property

The App, including its design, branding, text, and graphics, is owned by us and protected by intellectual property laws. Merchant names, logos, and trademarks that may appear belong to their respective owners and are used only to help you identify your own cards. These Terms do not grant you any rights in our or any third party’s trademarks.

6. Card Values and Balances

Balances shown in the App are values you enter and track yourself. They are estimates for your convenience and may not reflect the actual value available from the merchant. Always verify a card’s balance with the merchant before relying on it. We are not responsible for any discrepancy, expired value, or loss related to any card.

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL NOT BE LOST.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, GIFT CARD VALUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP, IF ANY.

9. Third-Party Services and Stores

The App is distributed through third-party app stores and uses third-party services (such as Google Firebase). Your use of the App is also subject to those parties’ terms. We are not responsible for third-party services.

10. Apple App Store Additional Terms

If you obtained the App from the Apple App Store, the following also applies:

• These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product-liability, legal, regulatory, or consumer-protection claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Termination

These Terms remain in effect while you use the App. You may stop using the App and delete it at any time. We may suspend or terminate your license if you violate these Terms. Sections that by their nature should survive termination will survive.

12. Changes to the App and Terms

We may modify or discontinue the App, or update these Terms, at any time. When we change these Terms, we will revise the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of your place of residence to the extent required by applicable consumer-protection law, and otherwise by the laws of the jurisdiction in which the provider operates, without regard to conflict-of-laws principles.
